Driving Laws and Cannabis

The legalization of medical marijuana is fairly new, so it is very important to familiarize ourselves with the laws. DUI’s are serious offenses; it is crucial that all medical cannabis patients know the rules for driving while under the influence in Mississippi.


Offenses

In Mississippi, there are different penalties depending on whether or not your DUI is your first offense.


If it is your first offense, you should expect a fine of at least $250 but not more than $1000 OR imprisonment of no more than 48 hours. First offenses will also get your license suspended for at least 90 days.


A second DUI offense within 5 years of your first will result in a fine from anywhere between $600-1500. You will also go to jail for at least 5 days but less than a year, and you will need to do community service.


Second offenses also mean a 2 year license suspension and sometimes vehicle impoundment, depending on the situation. You will be evaluated to determine whether treatment is required.


On your third offense, if your first two offenses are within 5 years, you will be charged with a felony. The fine will be between $2000-5000 and you will be jailed for anywhere from 1-5 years. Your vehicle will be seized and your license will be suspended for 5 years.


Also, keep in mind that if you refuse a field sobriety test, your license will automatically be suspended for 90 days.

It is very important to understand the dangers of driving while intoxicated. Marijuana is a psychoactive substance that can change how you feel and see things. You should never use marijuana if you think you will need to drive shortly after.
