Firearms and Medical Marijuana Cards: What to Know

There is much stipulation over medical marijuana and owning a firearm, and it can get a bit confusing. There is a lot of gray area, which is why it isn’t such a simple question to answer.


Although marijuana is legalized medicinally in 37 states and recreationally in 21 states, it is still considered a schedule I drug on a federal level. This basically means that it is highly illegal federally, and it is seen as “highly addictive”.


Because of this, there is no definitive answer about owning a gun despite what state you live in or what their laws are regarding marijuana. We'll try to break it down so it is a bit easier to understand.


Firearms and Cannabis

Technically, anyone with a “license to use” cannabis is not legally allowed to possess or buy firearms or ammunition. This is true for every state, no matter what their laws are regarding cannabis.


However, Mississippi stated in the Medical Cannabis Act that no state or local agency will be preventing medical marijuana patients from obtaining or possessing a gun.


When purchasing a gun, you will need to fill out form 4473 which warns that marijuana use under state law does not alter the federal Controlled Substances Act. It would be an entirely separate crime to lie about marijuana use on that form.


The Bottom Line

Although there is no state law that bans medical marijuana users from buying a firearm or ammunition, it remains illegal federally. If you lie on your application, you could face repercussions for that.


However, all of it is a very gray area. You should do what you are comfortable with but avoid breaking the law. Mississippi will probably not be enforcing this much, but it is best to avoid gray areas whenever possible, especially with federal laws.
